Terms of Use
Last updated: April 10, 2026These Terms of Use ("Terms") govern the relationship between Whenote Tecnologia Ltda. ("Company", "we") and the user ("you") of the Whenote platform ("Platform"), pursuant to Law No. 12,965/2014 (Internet Civil Framework) and Law No. 8,078/1990 (Consumer Defense Code). By registering, the user declares to have read and agreed to these Terms and the Privacy Policy.
Whenote is a digital platform for creating, sending, and receiving sealed letters and time capsules, which can be opened on specific dates or under conditions defined by the sender. The Platform operates as an intermediary service, enabling connections between users through emotional and temporal content. The Platform does not generate, alter, or edit user content.
Registration requires: full name, valid email address, and creation of a username and password. The user is responsible for the accuracy of the information provided and for maintaining the confidentiality of their credentials. Users must be at least 13 years old (COPPA). By creating an account, the user expressly consents to the processing of their personal data in accordance with the Privacy Policy.
It is prohibited to: (i) use the Platform to send threatening, defamatory, discriminatory, or illegal content; (ii) impersonate another person or entity; (iii) use automated bots or scripts to access the Platform; (iv) attempt to access other users' accounts or private data; (v) exploit vulnerabilities in the Platform's infrastructure. Violation of these rules may result in suspension or termination of the account.
Whenote exists to foster love, overcoming, and genuine connection. Content that harms has no place here. The Platform may use automated tools (including artificial intelligence) and human review to analyze content for potentially harmful material. Content deemed to violate these Terms may be blocked, removed, or flagged for review. Users have the right to contest moderation decisions. The Company is not responsible for the accuracy, legality, or quality of user-generated content, pursuant to Article 18 of the Internet Civil Framework.
The user retains copyright over the content they create, pursuant to Law No. 9,610/1998 (Copyright Law). By publishing content on the Public Feed, the user grants the Company a non-exclusive, irrevocable, free, and worldwide license to reproduce, distribute, and display such content exclusively within the Platform, revocable by deleting the content or account. The brand, logo, design, and source code of Whenote are the exclusive property of the Company.
This agreement remains in effect indefinitely from registration. The user may terminate at any time by deleting their account in Settings. The Company reserves the right to suspend or terminate accounts that violate these Terms.
Whenote makes every effort to ensure the delivery of all letters and capsules on the dates chosen by the sender. In the event of a planned discontinuation of services, the Company commits to: (i) notify all registered users by email and in-app notification at least 90 (ninety) days before the definitive shutdown; (ii) during the notice period, make available the export of all user data (letters, capsules, profile, media) via the app or email; (iii) deliver all locked letters whose opening date falls within the notice period; (iv) after the 90-day period, permanently and irreversibly delete all user data from its servers. The Company may establish a Continuity Fund — a financial reserve sufficient to maintain essential infrastructure for at least 2 (two) years even if the app ceases to generate revenue.
These Terms are governed by the laws of the Federative Republic of Brazil. The courts of Sao Paulo/SP are elected to resolve any disputes. The invalidity of any clause does not affect the remaining clauses. Questions and notices: juridico@whenote.app. Last updated: April 10, 2026.
Estes Termos de Uso ("Termos") regulam a relacao entre a Whenote Tecnologia Ltda. ("Empresa", "nos") e o usuario ("voce") da plataforma Whenote ("Plataforma"), nos termos da Lei 12.965/2014 (Marco Civil da Internet) e da Lei 8.078/1990 (Codigo de Defesa do Consumidor). Ao se cadastrar, o usuario declara ter lido e concordado com estes Termos e com a Politica de Privacidade.
O Whenote e uma plataforma digital para criar, enviar e receber cartas seladas e capsulas do tempo, que podem ser abertas em datas especificas ou sob condicoes definidas pelo remetente.
O cadastro exige: nome completo, e-mail valido, username e senha. O usuario e responsavel pela veracidade das informacoes e pela confidencialidade de suas credenciais. Idade minima: 13 anos (COPPA).
E proibido: (i) enviar conteudo ameacador, difamatorio, discriminatorio ou ilegal; (ii) se passar por outra pessoa; (iii) usar bots ou scripts; (iv) acessar contas ou dados de outros usuarios; (v) explorar vulnerabilidades.
O Whenote existe para fomentar amor, superacao e conexao genuina. Conteudo que prejudica nao tem lugar aqui. A Plataforma pode usar ferramentas automatizadas (incluindo IA) e revisao humana para analisar conteudo.
O usuario mantem os direitos autorais sobre seu conteudo. Ao publicar no Feed Publico, concede licenca nao exclusiva a Empresa.
Contrato por prazo indeterminado. O usuario pode encerrar a qualquer momento excluindo sua conta.
Em caso de encerramento planejado: (i) notificacao com 90 dias de antecedencia; (ii) exportacao de todos os dados disponivel; (iii) entrega de cartas bloqueadas dentro do periodo; (iv) exclusao permanente apos 90 dias. Possibilidade de Fundo de Continuidade para manter infraestrutura por 2 anos.

El registro requiere: nombre completo, correo valido, username y contrasena. El usuario es responsable de la veracidad de la informacion y la confidencialidad de sus credenciales. Edad minima: 13 anos (COPPA).
Esta prohibido: (i) enviar contenido amenazante, difamatorio, discriminatorio o ilegal; (ii) hacerse pasar por otra persona; (iii) usar bots o scripts; (iv) acceder a cuentas o datos de otros usuarios; (v) explotar vulnerabilidades.
